2. About PinkCard
PinkCard is a gift card product sold by PINK WALLET.
3. Eligibility
To use the Services, you represent and warrant that:
- you are at least eighteen (18) years of age or the age of legal majority in your jurisdiction
- you have full legal capacity to enter into binding contracts
- the information you provide is complete and accurate
- you are not prohibited by applicable law from using the Services
- you are not located in, ordinarily resident in, or acting on behalf of any jurisdiction subject to comprehensive economic or trade sanctions
- you are not identified on any applicable sanctions list maintained by Canada, the United Nations, OFAC, the European Union, the United Kingdom, or other applicable authorities.
Business customers further represent that they are duly organized and legally existing under the laws of their jurisdiction.
4. Account Registration
Certain Services require the creation of a PinkCard account.
When registering, you agree to:
- provide true, accurate and complete information
- maintain current contact information
- keep your credentials confidential
- immediately notify us of any unauthorized access
- promptly update any changes to your identity or business information.
You remain solely responsible for all activities conducted through your account unless otherwise required by applicable law.
We reserve the right to suspend, restrict or terminate any account where information is inaccurate, misleading or cannot be verified.
5. Identity Verification
To comply with applicable laws, regulations and our obligations to payment partners, we may require identity verification before providing certain Services.
Verification may include:
- government-issued identification
- facial verification or liveness checks
- proof of address
- source of funds or source of wealth information where required
- corporate registration documents
- beneficial ownership information
- business licensing documentation
- ongoing customer due diligence.

PinkCard may be issued by regulated issuing partners and remain subject to the applicable cardholder agreement.
Card availability may vary by jurisdiction.
Third-Party Service Providers
Some Services are provided by third-party regulated financial institutions, card issuers, payment processors, banking partners or licensed payment service providers.
Your use of such Services may also be subject to the applicable terms and conditions of those providers.
Where conflicts exist, mandatory legal or regulatory requirements applicable to those providers shall prevail.
7. Payment Authorization
By initiating a payment through your selected payment method, you authorize PINK WALLET TECHNOLOGY INC. and its authorized payment service providers to process the transaction using your selected payment method.
Supported payment methods may include:
- Visa
- Mastercard
- WeChat Pay International (where available)
- Alipay+ (where available)
- Apple Pay (where available)
- Google Pay (where available)
- Other payment methods supported from time to time.
You represent and warrant that:
- you are the authorized holder or authorized user of the payment method used
- all payment information provided is accurate and complete
- you have sufficient available funds or credit to complete the transaction
- the payment is lawful and not fraudulent.
Authorization of a payment does not guarantee acceptance of the transaction. We reserve the right to decline, suspend, or cancel any transaction where required by law, regulation, card network rules, or our internal risk controls.
8. Pricing and Fees
Fees applicable to the Services will be disclosed before you confirm your transaction or otherwise made available through our website or application.
We reserve the right to revise our pricing upon reasonable notice. Fee changes will not affect transactions that have already been completed.
9. Payment Processing
Payments are processed through regulated financial institutions and licensed payment service providers.
Transaction processing times may vary depending on:
- payment method
- issuing bank
- acquiring bank
- payment network
- compliance review
- fraud screening
- sanctions screening
- settlement requirements.
We are not responsible for delays caused by third-party financial institutions, payment networks, telecommunications providers, or circumstances beyond our reasonable control.
10. Currency Conversion
Transactions may be processed in different currencies.
Where currency conversion is required:
- applicable exchange rates may be determined by our payment partners, card networks, issuing institutions or other financial service providers
- additional foreign exchange fees may apply
- the final settlement amount may differ due to exchange rate fluctuations.
Unless otherwise required by applicable law, exchange rate differences do not constitute grounds for cancellation or refund.
11. WeChat Pay International
Where available, users may choose WeChat Pay International as a payment method.
By selecting WeChat Pay International, you acknowledge that:
- transaction processing is subject to WeChat Pay International's applicable operating rules
- payment authorization occurs within the WeChat Pay environment
- transaction approval is subject to fraud prevention and risk assessment
- additional authentication may be required.
PinkCard does not control the availability of WeChat Pay International in every jurisdiction or for every transaction.
We reserve the right to refuse or cancel any payment where required by law, payment partner requirements, or risk management policies.
12. Alipay+
Where available, users may choose Alipay+ as a supported payment method.
By using Alipay+, you acknowledge that:
- payments are processed through authorized payment service providers
- transactions remain subject to applicable regulatory requirements
- transaction limits may apply
- additional verification may be required.
Availability of Alipay+ varies depending upon country, merchant category, currency, and payment partner support.
13. Visa and Mastercard Payments
Payments made using Visa or Mastercard are subject to the applicable operating regulations of the relevant card network and the cardholder agreement between you and your issuing financial institution.
We may refuse, delay, suspend or cancel any transaction where:
- fraud is suspected
- unauthorized use is identified
- sanctions screening produces a potential match
- applicable laws require intervention
- payment network rules require rejection
- transaction monitoring identifies unusual or suspicious activity.
We reserve the right to request additional documentation before processing certain transactions.
14. Fraud Prevention
To protect users, payment partners and the integrity of our Services, we employ fraud prevention measures that may include:
- identity verification
- transaction monitoring
- device fingerprinting
- IP address analysis
- behavioral analytics
- sanctions screening
- politically exposed person (PEP) screening where required
- velocity monitoring
- payment authentication.
Transactions considered high risk may be delayed, declined, suspended or cancelled pending review.
15. Transaction Review
Certain transactions may require manual review.
During such review, we may request:
- additional identity documentation
- proof of ownership of the payment method
- proof of address
- supporting information regarding the purpose of the transaction
- source of funds documentation where required.
Failure to provide requested information within a reasonable time may result in transaction cancellation or account restrictions.
16. Failed Transactions
A transaction may fail for reasons including but not limited to:
- insufficient funds
- payment authorization failure
- expired payment credentials
- fraud prevention controls
- compliance review
- sanctions screening
- issuer decline
- payment network interruption
- technical errors.
Where possible, you may be permitted to resubmit the transaction.
We are not responsible for losses arising from transaction failures caused by third-party financial institutions or payment networks.
17. Refund Policy
Eligible refunds will be processed to the original payment method whenever reasonably practicable.
Refund eligibility depends upon:
- applicable law
- the nature of the product or service
- transaction status
- fraud review
- chargeback status
- contractual obligations.
Approved refunds are generally processed within 5–10 business days, although actual settlement times depend on the issuing financial institution or payment provider.
Certain digital products or services that have already been fully delivered may not be refundable except where required by applicable law.
18. Chargebacks
If a cardholder disputes a payment through their card issuer or payment provider, the transaction may become subject to a chargeback investigation.
You agree to:

- refrain from initiating fraudulent or abusive chargebacks.
Where a chargeback is determined to be fraudulent or abusive, we reserve the right to:
- suspend or terminate your account
- recover losses permitted by law
- report fraudulent conduct to payment partners or competent authorities where appropriate.
19. User Responsibilities
By using the Services, you agree to:
- comply with all applicable laws and regulations
- provide accurate, complete, and up-to-date information
- use the Services only for lawful purposes
- safeguard your account credentials and devices
- promptly notify us of any unauthorized access or suspected security incident
- cooperate with any compliance or verification requests reasonably required by us or our payment partners.
You are responsible for all activities conducted through your account unless otherwise required by applicable law.
20. Prohibited Activities
You must not use the Services for any unlawful, fraudulent, deceptive, or abusive purpose.
Without limitation, you agree not to:
- engage in money laundering or terrorist financing
- violate applicable sanctions or export control laws
- conduct fraudulent transactions or identity theft
- use stolen or unauthorized payment methods
- intentionally submit false or misleading information
- attempt to bypass transaction monitoring or security controls
- interfere with or disrupt our systems or networks
- engage in card testing, payment credential stuffing, or other forms of payment fraud
- exploit software bugs, security vulnerabilities, or system errors
- create multiple accounts to evade restrictions
- use the Services on behalf of another person without authorization.
We reserve the right to investigate any suspected violation of this Section.
21. Restricted Activities
Unless expressly approved by us in writing, the Services may not be used in connection with activities including:
- illegal gambling
- unlicensed financial services
- unlawful investment schemes
- counterfeit goods
- intellectual property infringement
- illegal pharmaceuticals
- prohibited weapons
- child exploitation material
- human trafficking
- ransomware or cybercrime
- unlawful cryptocurrency-related activities
- any activity prohibited by applicable law or by our payment partners.
We may update the list of restricted activities from time to time.
22. Anti-Money Laundering and Sanctions Compliance
We maintain policies and procedures designed to comply with applicable anti-money laundering ("AML"), counter-terrorist financing ("CTF"), sanctions, and other financial crime prevention requirements.
To support these obligations, we may:

- perform customer due diligence ("CDD")
- conduct enhanced due diligence ("EDD") where appropriate
- screen customers and transactions against applicable sanctions lists
- monitor transactions for suspicious activity
- request additional documentation regarding the source of funds or purpose of transactions
- report suspicious activities to competent authorities where required by law.
Failure to cooperate with these compliance measures may result in delayed transactions, account restrictions, suspension, or termination.
23. Compliance with Payment Network Rules
You agree to comply with all applicable payment network requirements relating to your use of the Services.
Transactions may be declined, reversed, or delayed where required by:
- card network operating rules
- payment service provider requirements
- applicable financial regulations
- fraud prevention measures
- legal or regulatory obligations.
Nothing in these Terms limits our ability to comply with lawful instructions issued by regulators, courts, law enforcement agencies, or payment partners.
24. Account Suspension and Termination
We may suspend, restrict, or terminate your account immediately if we reasonably determine that:
- these Terms have been violated
- fraudulent or suspicious activity is detected
- required verification cannot be completed
- continued provision of the Services would violate applicable law
- we are required to do so by a regulator, court, payment partner, or competent authority
- your use of the Services presents an unacceptable legal, compliance, operational, or reputational risk.
Where appropriate and legally permissible, we will provide notice of the suspension or termination.
Termination does not affect any rights or obligations that accrued before the termination date.
25. Security
We implement administrative, technical, and organizational safeguards designed to protect our Services and customer information.

Nothing in these Terms excludes or limits any warranty that cannot lawfully be excluded under applicable law.
31. Limitation of Liability
To the fullest extent permitted by applicable law, PINK WALLET TECHNOLOGY INC., its directors, officers, employees, affiliates, contractors, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, goodwill, business opportunities, or data, arising out of or relating to the use of the Services.
Where liability cannot be excluded by law, our total aggregate liability arising from or relating to the Services shall not exceed the total fees actually paid by you to PINK WALLET TECHNOLOGY INC. for the specific Service giving rise to the claim during the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes liability for fraud, willful misconduct, or any liability that cannot be excluded under applicable law.
32. Indemnification
You agree to indemnify, defend, and hold harmless PINK WALLET TECHNOLOGY INC., its affiliates, directors, officers, employees, contractors, licensors, and service providers from and against any claims, losses, damages, liabilities, penalties, fines, costs, and reasonable legal fees arising from or related to:
- your breach of these Terms
- your violation of applicable law
- your misuse of the Services
- your infringement of any third-party rights
- fraudulent, negligent, or unlawful conduct by you.
33. Force Majeure
We shall not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from events beyond our reasonable control, including:

- labour disputes
- governmental actions
- sanctions
- public health emergencies
- telecommunications failures
- internet disruptions
- failures of payment networks, banking systems, or third-party service providers.
Performance of affected obligations shall be suspended for the duration of the force majeure event.

The Services may integrate with or rely upon third-party providers, including financial institutions, payment processors, card issuers, technology providers, identity verification providers, and other business partners.
We are not responsible for the availability, performance, or acts or omissions of independent third-party providers.
Your use of third-party services may also be subject to separate terms and conditions imposed by those providers.
35. Changes to the Services
We may modify, update, suspend, or discontinue any part of the Services where reasonably necessary for legal, regulatory, security, operational, or commercial reasons.

The invalid provision shall be interpreted, to the extent possible, in a manner consistent with its original intent and applicable law.
